Is it real

Can a company that is not a law firm send me a TCPA demand letter?

Yes. A demand letter is a notice before a lawsuit, not a court filing, and no licence is needed to send one. The person called can pursue the claim themselves or through a company that refers unresolved matters to lawyers.

Yes. The TCPA creates a private right of action: 47 U.S.C. § 227(b)(3) and § 227(c)(5) let the person who received an unlawful call or text bring an action in their own name. Before anyone files, that person, or a company working for them, can write to the business and ask it to resolve the claim. That letter is a demand letter. It is correspondence, not a pleading, and no bar licence is required to send correspondence.

What a non-law-firm sender does

Typically it documents the calls, confirms the number was on the National Do Not Call Registry or that no consent existed, works out the statutory figure, and writes to the business. If the matter is resolved, a release is signed. If it is not, the matter is referred to a law firm that handles TCPA litigation, which files a complaint in the name of the person called. The sender's name may never appear on a docket, which is why searching PACER for it tells you less than you might expect. What changes once a matter is referred is set out in how long after a demand letter does a TCPA lawsuit come.

Why this objection does not help

"They are not even a law firm" is the first thing many owners say, and it changes nothing about the calls. The question a court asks is whether the calls were made in breach of the statute, and the answer comes from your records. The absence of a bar number on the letter is not a defence and not a sign of fraud. A sender that cannot be found in any state registry and demands untraceable payment is a different matter; see how to tell a fake letter.

If they are not lawyers, can they sue me?

The company itself does not file. Unresolved matters are referred to litigation counsel, who files in the name of the person who was called. The letter is the step before that.

Is it the unauthorised practice of law?

Sending a demand on behalf of a person with a claim, before any filing, is ordinary correspondence. Representing someone in court is the lawyer’s job, which is why referral happens if the matter is not resolved.

Does a letter signed by an officer rather than a lawyer carry less weight?

The weight of the letter comes from the calls it lists, not the signature. If your logs show the calls, the signature block does not change the exposure.
